1. Agreement to Terms

By accessing and using the Aqua Pranah Pranah mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the App.

3.3 Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• Your account is used for fraudulent activities
• You provide false or misleading information
• Your account remains inactive for over 12 months

4. Use of the App

4.1 Permitted Uses

You may use the App to:

• Track fish farming expenses and income
• Record financial transactions related to your farm
• Generate reports and analytics about your operations
• Scan receipts and documents using the camera feature
• Manage multiple pond records

4.2 Prohibited Uses

You agree NOT to:

• Use the App for any illegal purposes
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Upload malicious code, viruses, or harmful content
• Use automated scripts or bots to access the App
• Scrape or extract data from the App
• Impersonate another user or entity
• Share or sell your account credentials
• Use the App to harass or harm others
• Submit false or fraudulent financial data

5. Camera and Device Permissions

5.1 Camera Access

The App requests camera permission for:

• Scanning receipts and invoices
• Documenting expenses visually
• Capturing images of farm-related purchases

By granting camera permission, you:

• Confirm you have the right to photograph any documents you scan
• Understand that images are processed for text extraction
• Accept that images may be stored if attached to expense records
• Can revoke camera permission at any time via device settings

5.2 Other Permissions

The App may request additional permissions such as:

• Storage access: To save and retrieve local data
• Internet access: To sync data with cloud servers
• Notification permission: To send important alerts

All permissions are used solely for app functionality as described in our Privacy Policy.

6. Financial Data and Accuracy

You are solely responsible for:

• Maintaining accurate pond and farm information

• Makes no guarantees about financial outcomes or predictions

6.3 Data Backup

While we implement regular backups, you should:

• Maintain your own copies of important financial records
• Export data regularly using the app's export features
• Not rely solely on the App for critical financial documentation

7. Intellectual Property Rights

The App and all its content, including but not limited to:

• Software code and algorithms
• User interface and design
• Logos, trademarks, and branding
• Text, graphics, and images
• Database structure and organization

are owned by or licensed to Aqua Pranah Pranah and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Data

You retain ownership of all data you input into the App. By using the App, you grant us a limited license to:

• Store and process your data to provide app services
• Create anonymized, aggregated analytics
• Back up your data for recovery purposes

We will not sell or share your specific financial data with third parties without your consent.

8. Subscription and Payments

8.1 Free Tier

The App currently offers a free tier with core features. We reserve the right to:

• Introduce premium features or subscription plans in the future
• Limit features or usage on free accounts
• Provide at least 30 days notice before implementing charges

8.2 Future Paid Services

If we introduce paid features:

9. Disclaimers and Limitations of Liability

You agree to indemnify, defend, and hold harmless Aqua Pranah Pranah, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of any third-party rights
• Any fraudulent or illegal activity through your account
• Inaccurate data you provide

11. Modifications to the App and Terms

11.1 App Modifications

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the App
• Update features, functionality, or design
• Change technical requirements
• Impose limits on certain features

We will provide reasonable notice for major changes that significantly affect functionality.

11.2 Terms Updates

We may update these Terms at any time. Changes will be effective:

• Immediately upon posting for minor, non-material changes
• 30 days after notification for material changes

Continued use of the App after changes constitutes acceptance of the modified Terms.

12. Termination

12.1 Termination by You

You may terminate your account at any time through the app settings. Upon termination:

• Your account will be immediately deactivated
• You will lose access to all data within 30 days
• You should export any data you wish to retain beforehand

12.2 Termination by Us

We may terminate or suspend your account immediately if:

• You breach these Terms
• We are required to do so by law
• Your account is used fraudulently
• You engage in prohibited activities

12.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ends
• Sections 7, 9, 10, 13, and 14 of these Terms survive termination
• We may retain certain data as required by law

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya, without regard to conflict of law principles.

13.2 Dispute Resolution

In case of disputes:

2. Mediation: If informal resolution fails, parties agree to mediation before pursuing litigation
3. Jurisdiction: Any legal action must be brought in courts located in Nairobi, Kenya

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Data Policy, constitute the entire agreement between you and Aqua Pranah Pranah regarding the App.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, or internet service failures.
